Qualifications

Legal Assistant Trainee 1

One year of clerical, secretarial, keyboarding, or paraprofessional experience in an office environment.

Legal Assistant Trainee 2

This title is not eligible for appointment under the NY HELPS Program.

Legal Assistant 1 (Full Journey Level)

An associate degree in a paralegal/legal assistant program or a certificate in a paralegal/legal assistant program where either the degree or certificate was granted from a regionally accredited college or university, or college or university accredited by the Accrediting Council for Independent Colleges and Schools (ACICS) or one approved by the American Bar Association (ABA).


Other Ways to Qualify:

  • You're currently reachable on the the appropriate eligible list for this title,
  • You're eligible under the 55 b/c program, OR
  • For 70.1 or 70.4 transfer to a Legal Assistant 1, salary grade (SG)-14, you must have one year of permanent competitive, or 55-b/55-c service in an approved title for transfer allocated to a SG-12 or above. SG-09 or above for a Trainee 1, SG-11 or above for a Trainee 2, depending on qualifications. To determine if you're current Civil Service title is eligible for transfer to this title, visit the Career Mobility website. Appointments via transfer must not result in a second, consecutive transfer with an advancement of more than two S-grades or one M-grade. Depending on qualifications, you may be required to serve a 1 or 2-year traineeship that leads to the full level SG-14 position.

Duties

When in a litigation or administrative hearing setting, performs pre-trial or pre-hearing related activities:

  • Schedules witnesses and collects information relevant to the case.
  • Reviews case-related materials for lines of questioning.
  • Assembles exhibits and briefs.
  • May assist at trials or hearings by managing the exhibits and suggesting relevant questions for the attorney to raise.
  • Prepares and files with the courts all associated court papers as directed or authorized by the attorney.
  • May perform service of process or arrange for service of process through an outside vendor.
  • Calculates monies owed to the State, determines responsible parties, and locates and notifies them of the amount.
  • Reviews administrative procedures and makes initial determinations regarding information releasable under the Freedom of Information Act.
  • Negotiates and proposes preliminary settlements of fines as directed or authorized by the attorney.
  • Completes routine investigative work for attorney review.
  • Gathers complete information from a variety of sources.
  • Provides a preliminary analysis of information to attorneys.
  • Reviews draft legislative proposals for compliance with bill drafting requirements.
  • Manages the flow of case-related materials.
  • Uses Shepard's Citations or other reference sources to check the cases cited to ensure that the case law is still relevant.
  • May maintain or oversee tracking systems, calendars, and reporting systems.
  • May open and close files or cases or oversee the process of opening or closing files and cases.
  • Performs activities related to docketing, the placement of court-related activities on the court calendar, and on the attorney's calendar.
  • May draft legal responses to the courts or other interested parties as directed or authorized by the attorney.
  • May prepare portions of briefs, affidavits, affirmations, and other motion-related papers.
  • Answers routine questions from the public.
  • Prepares findings of decisions and findings of fact.
  • Prepares opinions on routine matters.
  • Prepares reports.
  • When located outside of a litigation or an administrative hearing setting, performs preliminary background work for routine cases or for administrative review processes.
  • May answer routine complaints received from the public, either orally or in writing, and provides routine information regarding processes or procedures to the public.

Desired Competencies

  • Associate degree in paralegal studies supplemented by a four-year degree preferred.
  • Experience with litigation or real property or collection law desired.
  • Proficient in excel and/or access applications.
  • Experience dealing with the public in any field.

Telecommuting

The Office of the New York State Comptroller (OSC) supports telecommuting where it is reasonable to do so based upon the agency’s mission and operational needs. Generally, employees new to OSC will be restricted from telecommuting for at least 8 calendar weeks. After the initial 8 calendar week restriction, if an employee’s duties and work performance are aligned with telecommuting they may be allowed to do so. Upon approval to telecommute, OSC employees may telecommute up to 5 days per pay period.
